OBC Quota In-Creamy Layer Out In Higher Education-Supreme Court

The verdict is out. The Supreme Court consented to the controversial OBC quota in higher Central education institutions.
But there is a rider attached as the creamy layer has been kept out. The court has also recommended reservations should be reviewed every five years.

The Supreme Court has gone with the Parliament and given the go ahead to the politically explosive 27 per cent quota for OBCs.

Now, all central institutes like IITs, IIMs, AIIMS will provide quota for OBCs.

But the five-judge constitution bench did put some conditions:-

  • Families earning more than 2.5 lakh rupees per year, the creamy layer, will not be eligible for quota
  • The OBC list should be reviewed every five years
  • One of the Judges specifically said children of MPs and MLAs both past and present should not get reservation

The man who pushed for 27 per cent quota, HRD Minister Arjun Singh is beaming and the timing of the judgement couldn’t be better for Congress with Karnataka elections next month.

The five judges said that 27 per cent quota for OBCs does not in anyway violate the constitution and added there is harm in quota being implemented from the current admission process.
